SERVICE
CONTRACT
FOR
COOLED
SEMEN
Almond Tree Farms
This CONTRACT for the breeding season
of _______, is made and entered into on ___________ by
and between Jim & Marti Retzer of Almond Tree Farms,
hereinafter designated Breeder, and _____________________
hereinafter designated Mare Owner. Mare Owner agrees to
breed the mare __________________________
Reg.No._____________________, to the stallion Fairly Tall
Tale, Reg. No. 3286396 for the fee of $__________ for
semen and $ ________chute fee, for a live foal, subject
to the following conditions:
1. Fee -- The STALLION SERVICE
CONTRACT fee is $________ including booking fee. A
non-refundable booking fee of $________ is due at
signing and acceptance of this
contract with a nonrefundable
balance of $___________ payable before the semen is
shipped (or picked up) and the mare is bred. Chute
fee is additional and for 3 collections.
2. Deposit -- An additional deposit
of $__________ must be paid before shipment of semen
. It includes the following.
- A. Packaging for semen
- B. Shipping fees (FedEx, Air,
etc.)
- C. Custom fees if applicable
- D. If deposit is exhausted
prior to conception an additional deposit
will be required and no shipments will be
made until receipt of additional deposit.
- ** NOTE ** if same shipping
container and all interior parts are returned
in good condition using over-night service,
credit will be given and remaining unused
portion of deposit will be returned at time
mare is pronounced 'safely in foal' by
attending veterinarian. There will be a
$15.00 per day charge taken from deposit for
every day container is overdue.
3. Reservation -- Receipt of the
above mentioned STALLION SERVICE CONTRACT, breeding
fees and signed contract confirms the mare's
reservation to breed to the above named stallion for
the current breeding season from February 15 to July
15 of the current year.
- A. The mare owner requests the
following month for breeding:_______________
- B. All requests for semen
shipments shall be filled as received,
subject to availability of stallion's semen
and the farm veterinarian's approval. If
there is insufficient semen to fill orders on
a given day the farm veterinarian will
determine which orders will be honored. This
decision will be based on information
provided by the mare owner's veterinarian,
and is usually on a first call, first served
basis.
4. Conditions -- Stallion service
will be provided to only healthy mares in sound
breeding condition determined by a veterinarian
acceptable to Almond Tree Farms. In the event the
mare is barren, Almond Tree Farm requires the
purchaser's veterinarian to submit a current negative
intrauterine culture certificate (within 60 days) and
certify the immunization from equine rhino
pneumonitis (equine herpes type 1) have been kept
current.
- A. There will be a maximum of
three (3) shipments of semen under item No. l
fees. In the event the mare does not conceive
on the third shipment, the mare must be
serviced at the breeding farm, unless
specific arrangements are made.
5. Return of Service -- Purchaser
shall not be entitled to a return of fees unless
conditions in No. 6 are present. The mare will have
the right of return to the stallion in the _______
breeding season under the following circumstances:
- A. If the mare does not settle
during the present breeding season with
breeding attempted during a minimum of 3
breeding cycles, she is eligible to return in
______ if the purchaser submits a
veterinarian's certificate to that effect.
- B. If the mare is examined to
be in foal, but barren during gestation, she
is eligible for return if Almond Tree Farms
receives a veterinarians certificate of
barrenness within five days of examination.
- C. If the mare aborts or
produces a live foal that is unable to stand
alone and nurse and subsequently dies, a
veterinarian's certificate must be provided
to Almond Tree Farms within seven (7) days
from date of death.
- D. If APHA mare has breeding
stock foal and photographs are submitted
within 14 days of foaling.
- E. In each and all cases the
required veterinarian certificates shall
affirm that the mare had been immunized (see
item 4 conditions). Where appropriate, the
certificate shall confirm that the
mare was property cared for during gestation
and was attended during foaling. Timely
receipt of required certificates is a
condition precedent to any return.
- F. All rights of return to the
stallion are subject to prepayment of costs
listed in 1 and 2.
6. Refund of Fees -- This agreement
shall be null and void and the purchasers shall be
entitled to a refund of any amount paid if the
stallion should die become unfit for service prior to
servicing the mare in the current breeding season.
7. Non-Assignment -- This agreement
cannot be transferred or assigned by the purchaser.
There shall be no right of return to the stallion if
the mare is sold or otherwise changes ownership after
being serviced by the stallion.
8. Governing Law -- This contract
shall be governed by the laws of the County of Butte,
State of California, and shall be binding upon the
parties hereto and their personal representatives.
